Terms and conditions for the United States
Draft text pending legal review before final publication. These terms govern the use of the United States version of the PACOWEB S.A.S. website and the general conditions for remotely engaging our web design, apps, business platforms, automation and AI, digital advertising, SEO, and digital marketing services. By browsing the site or accepting a proposal, you agree to these terms. Each project is formalized with a contract, and whatever that contract stipulates takes precedence over these general terms.
1. Company information
The site is operated by PACOWEB S.A.S., a Colombian company with NIT (Colombian tax ID) 901148017-1, located at Carrera 26 # 51-84, Oficina 201, Galerías neighborhood, Bogotá, Colombia. We provide services to US businesses remotely. Email: info@pacoweblatam.com. Phone: +57 601 256 8249.
2. Use of the website
You may use this site to learn about our services and contact us. You may not:
- Use it for illegal purposes or in ways that harm third parties.
- Attempt to gain unauthorized access to its systems or interfere with its operation.
- Copy or reproduce its content for commercial purposes without authorization.
3. Quotes
Every quote is provided in writing, in U.S. dollars (USD), and states the scope, deliverables, estimated timelines, payment terms, and price. It is valid for the period stated in it. Anything outside the scope is quoted separately.
4. Acceptance and engagement
A service is engaged when you accept the proposal in writing, by email, by electronic signature, or by any other means that leaves a record, and the agreed initial payment is received. Electronic acceptance and signatures are fully valid under the US federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and Colombia’s Law 527 of 1999.
5. Payments
- Prices are stated and paid in US dollars (USD).
- We accept Visa, Mastercard, and American Express cards, as well as payments through PayPal and Stripe.
- Payments are made according to the schedule in the proposal, usually in stages.
- Invoices are issued by PACOWEB S.A.S. from Colombia.
- The client is responsible for any sales or use tax, withholding, or other tax that may apply in its jurisdiction.
- Fees charged by the client’s bank or payment platform, and currency exchange differences, are the client’s responsibility, unless the proposal states otherwise.
- Late payments may pause project work until the account is brought current.
- Third-party services (domains, hosting, licenses, ad spend) are governed by each provider’s terms.
6. Client obligations
- Provide the necessary copy, images, access credentials, and information on time.
- Review and approve each stage within the agreed time frames.
- Warrant that it holds the rights to the materials it provides.
- Comply with the laws that apply to its business and to the content of its website, app, or campaigns.
Delays in providing these items may shift the project dates.
7. Intellectual property
Once the full project price has been paid, the economic rights to the custom designs and developments transfer to the client. Until full payment, they remain the property of PACOWEB S.A.S.
Third-party templates, plugins, libraries, and tools retain their own licenses. PACOWEB may mention the project in its portfolio unless we agree otherwise in writing.
8. Warranty
Web projects include 6 months of warranty and support from delivery to fix defects in the delivered work. The warranty does not cover scope changes, new content, defects caused by modifications made by third parties or the client, or issues with external services.
9. Limitation of liability
PACOWEB provides its services with professional diligence. It does not guarantee search engine rankings or specific business results, as these depend on external factors. It is not liable for outages of hosting providers, advertising platforms, or other third-party services.
The liability limits, warranties, and other commitments for each project are those set out in the contract signed with the client.
10. Prohibited hosting content
The following may not be published or stored on hosting services we manage:
- Illegal or fraudulent content, or content that infringes copyrights or trademarks.
- Child sexual abuse material, or violent or hateful content.
- Malware, phishing, or unsolicited bulk email.
If we detect such content, we may suspend the service and notify the authorities.
11. Privacy
Personal information is handled in accordance with our privacy policy for the United States.
12. Governing law and jurisdiction
The parties will first attempt to resolve any dispute through direct, good-faith negotiation. Unless the written proposal states otherwise, these terms are governed by the laws of the Republic of Colombia and, if no agreement is reached, the dispute will be submitted to the competent courts of Bogotá, Colombia.
13. Changes to these terms
